Terms & Conditions

Terms and Conditions

Effective date: 09/25/2024

These Terms and Conditions govern your use of twinfallstheatre.com and purchases made through the website. Twin Falls Theatre Collective is referred to as “we,” “our,” or “us.” By using the website or completing a purchase after being presented with these terms, you agree to these Terms and Conditions. If you do not agree, please do not use the website or place an order.

Website Use

You agree to use our website for lawful purposes and provide accurate information when making purchases, submitting forms, or contacting us. You may not interfere with website security, attempt unauthorized access, submit fraudulent orders, or use our website to distribute harmful or unlawful content.

If you make a purchase or enroll in a messaging program, you must be at least 18 years old or have authorization from a parent or legal guardian. You must be authorized to use the payment method and contact information you provide.

Orders and Payments

Tickets and other offerings are subject to availability. Prices, applicable taxes, and any fees will be displayed before you complete checkout. You authorize us and our payment service providers to process the payment you approve at checkout.

Please check the production, performance date, time, quantity, and any seat selection before purchasing. Contact us promptly if your confirmation contains an error or your tickets do not arrive. Please also check your spam or junk folder.

We may decline or cancel orders involving suspected fraud, unauthorized payment, or a material listing error. If we cancel a paid order, we will return the amount collected for the canceled items.

Ticket Refunds and Performance Changes

Tickets are non-refundable, except as required by law or expressly provided in the applicable event terms. Exchanges or transfers are available only if we approve them or the event listing expressly permits them.

Performance schedules, casts, and production details may change. If a performance is canceled or rescheduled, we will communicate the applicable ticket options to affected purchasers. Nothing in these terms limits any refund rights required by applicable law.

Admission and Event Conduct

Admission requires a valid ticket when tickets are required. Attendees must follow posted venue rules and reasonable staff instructions. Event-specific age restrictions, accessibility information, and late-seating policies, where applicable, will be provided with the event information or by our box office.

We may refuse admission or remove individuals for disruptive behavior, harassment, unsafe conduct, or violation of venue rules, subject to applicable law. Unauthorized recording, photography, or distribution of a performance is prohibited where restricted by the production or venue.

Email Communications

When you purchase from us, we may send emails needed to process your order, deliver tickets, or communicate performance changes. If you subscribe to our email mailing list, we may also send production announcements, theatre news, and promotional emails. You may unsubscribe from promotional emails using the unsubscribe link. Unsubscribing from marketing does not prevent necessary order-related emails.

SMS Communications and Consent

Order and Service Messages

If you provide a mobile number and affirmatively agree to receive order or service texts through the disclosure presented at checkout or on a form, you authorize Twin Falls Theatre Collective to send SMS messages related to the stated purpose. These may include order confirmations, ticket assistance, performance reminders, schedule changes, and customer support. Messages may be sent using automated technology.

Marketing Messages

If you separately opt in to SMS marketing at checkout, on a mailing-list signup form, or through another clearly disclosed enrollment method, you authorize Twin Falls Theatre Collective to send recurring promotional text messages to the mobile number you provide, including through automated technology. Messages may include upcoming productions, ticket availability, special offers, and theatre news.

Consent to receive marketing texts is not a condition of purchasing tickets or any other goods or services. Completing an order, supplying a telephone number, accepting these terms, or subscribing to an email list does not by itself enroll you in SMS marketing. An email subscription does not constitute an SMS subscription.

Customer-Initiated Texts

If you text us first, you consent to receive replies and related follow-up texts reasonably necessary to address that inquiry. This consent is limited to the conversation and does not enroll you in recurring promotional texts. Separate marketing consent is required for that program.

Message Frequency and Charges

Message frequency varies based on your orders, inquiries, and subscriptions. Message and data rates may apply. You are responsible for charges imposed by your mobile carrier. SMS delivery depends on your carrier and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

Opting Out and Getting Help

Reply STOP to unsubscribe from SMS messages. We also honor other clear requests to stop messages, including requests sent to our contact email. You may receive one non-promotional text confirming your opt-out. After opting out, you will not receive further messages covered by that opt-out unless you provide new consent.

Reply HELP for assistance or contact boxoffice@twinfallstheatre.com. Opting out of SMS does not cancel an order or an email subscription. Necessary order information may still be provided through other permitted channels.

You represent that you own or are authorized to use the mobile number you provide. Please notify us if your number changes or is reassigned. Our use of messaging information is described in our Privacy Policy.

Intellectual Property

Website content, including our original text, graphics, and branding, belongs to us or the relevant rights holders. Production titles, artwork, scripts, music, and other licensed materials remain the property of their respective owners. Website access does not grant permission to reproduce, distribute, or commercially exploit these materials without authorization, except as permitted by law.

Third-Party Services

Our website may link to or use third-party payment, ticketing, social media, or other services. Their own terms and privacy policies govern your use of their services. We are not responsible for third-party websites or practices outside our control.

Website Availability and Liability

We work to keep website information accurate and the website available, but errors and interruptions may occur. To the extent permitted by law, the website is provided on an “as available” basis without warranties regarding uninterrupted access or freedom from errors.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the website. These terms do not exclude liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other protected rights.

Governing Law and Changes

These terms are governed by the laws of Idaho, without regard to conflict-of-law rules, subject to applicable mandatory consumer protections. If a provision is unenforceable, the remaining provisions remain in effect.

We may update these terms by posting a revised version and effective date. Revised terms apply prospectively; material changes to an existing order or messaging consent will require any notice or consent required by law.
